Pawn loans in French Guiana: the current situation and rules

French Guiana has no Mont-de-Piété: the IEDOM list of banking institutions, with 2023 data, records no Crédit Municipal institution there, although the law reserves loans secured on movable goods for these bodies; no mainland branch is reported locally.

Cayenne, Kourou, Saint-Laurent: the same finding

Whether you live in Cayenne, Kourou or Saint-Laurent-du-Maroni, no institution in French Guiana offers public pawn loans. The IEDOM list of banking institutions in the overseas euro area, based on 2023, cites no Crédit Municipal institution in the territory.

Nine credit institutions, no pawnshop

For French Guiana, the IEDOM lists BNP Paribas Antilles Guyane, Crédit commercial de France, Bpifrance, La Banque Postale, BRED Banque Populaire, CEPAC, LCL, CFCM and the CRCAM Martinique et Guyane. None has the status of a Crédit Municipal institution.

Specialised finance and the Caisse des Dépôts

The finance companies CMAG and SOMAFI-SOGAFI also operate in French Guiana, as does the Caisse des Dépôts et Consignations, an institution with special status. These players offer other products; the 2023 document attributes no pawnbroking activity to them.

Your bank cannot take an item as a pledge

Service-public factsheet F1354 makes it clear: pawn loans are offered only by the Crédit Municipal institutions, and they cannot be obtained through your usual bank. An adviser in French Guiana will therefore point you to ordinary credit, not to a pledge.

The legal basis of the monopoly

Article L514-1 of the Code monétaire et financier, in force since 8 November 2014, defines the Crédit Municipal institutions as municipal public bodies tasked with combating usury. The monopoly on loans secured on movable goods belongs exclusively to them.

No specific regime for the overseas territories

In its factsheet 221 of May 2021, the Banque de France makes no provision specific to the overseas territories, the IEDOM or the IEOM for these institutions. French Guiana thus has neither its own rule nor a municipal institution to offer this loan.

How long a pawn loan lasts in mainland France

Under article D514-7, the term set by each institution may not exceed two years, extensions included; service-public often refers to six months or one year. The rules are detailed on our page on the duration of a pawn loan in France.

No cooling-off period, no income condition

Service-public points out that no income condition applies and that there is no right of withdrawal for this loan. A resident of French Guiana signing in mainland France must therefore weigh the commitment before leaving the counter.

If the item is not redeemed

Without repayment or renewal, the institution has the item sold at public auction. According to service-public, the borrower owes nothing further if the sale does not cover the debt, and receives the surplus otherwise.

The Crédit Municipal de Paris caters for residents of Paris and the Île-de-France region, and the sources consulted confirm no postal dispatch of items from overseas. Any application therefore means contacting the target institution and turning up with the item.

Can a bank in French Guiana grant a pawn loan?
