Saint Barthélemy and pawn loans: the actual situation

Saint Barthélemy has no Mont-de-Piété: IEDOM, which covers the territory within its euro zone, lists no Crédit Municipal on the island in 2023, even though these institutions hold the monopoly on loans against pledged personal property in France.

Six credit institutions, no Crédit Municipal

The IEDOM list of overseas banking institutions in the euro zone, with 2023 data, names for Saint Barthélemy BNP Paribas Antilles Guyane, La Banque Postale, BRED Banque Populaire, CEPAC, LCL and Crédit Agricole de la Guadeloupe. No Crédit Municipal appears on it.

A territory monitored by IEDOM

Although it is an overseas collectivity separate from Guadeloupe, Saint Barthélemy falls within the euro area of operation of IEDOM, like Saint Martin. The IEDOM document on the euro zone collectivities is therefore authoritative for the island.

Banking ties with Guadeloupe

The legal framework set by Article L514-1

The Code monétaire et financier entrusts the Crédit Municipal institutions, municipal public bodies, with combating usury through loans against pledged personal property, over which they hold a monopoly. None of these institutions is based in Saint Barthélemy, according to the sources consulted.

Valuable jewellery and watches: what options

A valuable watch or piece of jewellery cannot be pledged with a bank on the island. The only legal route is a mainland institution, where a commissaire-priseur values the item; the method is explained on the page about valuing a pledged item.

What a mainland institution lends

Article D514-8 limits the loan to two thirds of the valuation, or four fifths for gold, silver and platinum valued by weight. Crédit Municipal de Paris advertises a minimum of 30 euros and a maximum of 5 million euros.

Customer conditions to check

Crédit Municipal de Paris describes itself as open "to all Parisians and residents of Île-de-France" and requires original paper documents at the time of deposit. A Saint Barthélemy resident must obtain the chosen institution's agreement before crossing the Atlantic with the item.

Mandatory display of terms

Since 1 July 2016, Article D514-8-1 has required each institution to inform its customers on fifteen categories of information, including fees, the APR and sale arrangements, displayed at reception. Insist on this information before signing.

Saint Martin, the neighbouring island

A short distance away, the French part of Saint Martin has no Crédit Municipal either, according to IEDOM 2023. Its banking situation is described on the page about pawn loans in Saint Martin.

Pledge, sale or consignment: know the difference

In Gustavia, a jeweller may buy an item or take it on consignment, but these transactions are not pawn loans. Only a Crédit Municipal contract allows you to recover the item by repaying the principal, interest and fees.

When the item is not redeemed

Without redemption or renewal, the institution sells the pledge at auction; a price above the debt gives the borrower a surplus, while a lower price creates no debt, according to service-public. The national rules are set out on the page about pawnshops in France.

Spotting a fake Mont-de-Piété

The Crédit Municipal institutions are authorised by the ACPR, as Banque de France factsheet 221 points out. Any outfit on the island that claims to offer pawn loans without appearing on the IEDOM list or showing an authorisation should be avoided.

  1. Check the 2023 IEDOM list to confirm that no Crédit Municipal operates in Gustavia or elsewhere on the island.
  2. Distinguish a jeweller's offer, whether purchase or consignment, from a genuine pawn loan with the right to recover the item.
  3. Ask a mainland institution whether it accepts a Saint Barthélemy resident and which documents it will require.
  4. Gather originals of identification, proof of address, current account bank details, and the item's invoices and certificates.
  5. Have the item valued at a branch, then read the valuation slip and the displayed information before signing.
  6. Note the due date and arrange remote payment of interest or redemption to avoid the sale.

Is there a Mont-de-Piété in Gustavia?

No. The 2023 IEDOM list of banking institutions in Saint Barthélemy includes no Crédit Municipal. The six banks listed, from BNP Paribas Antilles Guyane to Crédit Agricole de la Guadeloupe, do not offer pawn loans.

Where can I pawn jewellery from Saint Barthélemy?

Only at a Crédit Municipal, all of which are located in mainland France according to the sources consulted. The item must be deposited at a branch to be valued; first ask about the reception of customers living outside the institution's region.

How much does a Crédit Municipal lend on a luxury watch?

At most two thirds of the valuation made by the commissaire-priseur. In practice, Crédit Municipal de Paris advertises 50% to 80% of the estimated value depending on the item, and Strasbourg asks for an invoice in the depositor's name and a certificate for a watch.

Does Saint Barthélemy depend on Guadeloupe for banking?
