French Saint Martin: no official pawn institution

The French part of Saint Martin has no Mont-de-Piété: the 2023 IEDOM list records only five credit institutions there, none of them a Crédit Municipal, the only bodies authorised in France to lend against the deposit of an item.

Five banks on the French side, no pawn office

For Saint Martin, IEDOM lists La Banque Postale, BRED Banque Populaire, CEPAC, LCL and CFCM in 2023. This is the shortest list of credit institutions in the French Antilles in that document, and none of these institutions is a Crédit Municipal.

One island shared, two systems

The island is divided between the French collectivity and Sint Maarten, the Dutch part. French pawn loan rules, and the IEDOM list, concern only the French side; the sources consulted provide no information on the Dutch part.

IEDOM as the official reference

Saint Martin falls within the euro area of operation of IEDOM, together with Saint Barthélemy and the Antilles departments. The document "Breakdown of the main banking institutions", taken from the 2023 annual report, underpins this finding of absence.

Why a bank cannot take your jewellery

Article L514-1 of the Code monétaire et financier grants the Crédit Municipal institutions the monopoly on loans against pledged personal property. According to service-public factsheet F1354, you cannot go through your usual bank for this type of loan.

No income test, no cooling-off period

Service-public states that a pawn loan requires no income conditions and carries no right of withdrawal. These features, specific to the Crédit Municipal institutions, are not found in an advance made by a private individual on the island.

Saint Barthélemy and Guadeloupe, same finding

The neighbouring islands are no exception: IEDOM lists no institution in Saint Barthélemy, which has no Mont-de-Piété or in Guadeloupe for pawn loans. The whole archipelago therefore relies on the mainland institutions.

Length of a contract in mainland France

A loan taken out in mainland France often runs for six months or a year; Article D514-7 prohibits exceeding two years, extensions included. Living in Saint Martin means planning from signature how interest will be paid remotely.

Renewing from a distance

Crédit Municipal de Paris allows renewal from 30 days before the due date, free of charge and remotely; payment by card is possible up to 1,500 euros, and above that by bank transfer stating surname, first name and contract number.

The price of a delay from the Antilles

The Paris general terms as at 1 May 2026 provide for 0.50% of the principal per fortnight of delay begun, up to a limit of twelve fortnights. A transfer lag between Marigot and mainland France can therefore prove expensive.

If the item goes to auction

An unredeemed pledge is sold at public auction; in Paris the sale is announced at least ten days in advance and 15% of the hammer price is retained as fees. The process is explained on the page about the auction of a pledged item.

Claiming the surplus from Saint Martin

At Crédit Municipal de Paris, the surplus (boni) remains available for two years after the sale and can be requested by post with a copy of your identity document and bank details for an account in France. A Saint Martin resident can therefore obtain it without travelling.

Before pledging a piece of jewellery, compare the mainland institutions and their terms, presented in the general guide to pawn loans and the Mont-de-Piété. Turn down any outfit on the island that claims to be a pawnbroker without ACPR authorisation.

  2. Do not confuse an advance between private individuals or a gold sale with a pawn loan governed by law.
  3. Contact a mainland institution to find out whether it accepts a customer domiciled in Saint Martin.
  4. Deposit the item at a branch with the required originals and check the valuation slip before signing.
  5. Schedule renewal or repayment by transfer, allowing for banking delays from the Antilles.
  6. If the item is sold, request the surplus by post within the period set by the institution, two years in Paris.
